HIV-specific entry and residence regulations for Ukraine

Ukraine has updated its Law on Prevention of AIDS and Social Protection of Population. Among other changes, restrictions on entry for HIV-positive people have been removed.

Author’s note: We often get inquiries about PLHIV who want to study in Ukraine. Some universities seem to request negative HIV tests, or in some cases, visa applicants are concerned about unspecified health testing during the visa application process. HIV infection is no grounds for refusing visa or study permits.

The Ukraine regulation on the “admission of foreigners and stateless persons to study at higher educational institutions” from August 5, 1998 N 1238 is no longer valid. https://zakon.rada.gov.ua/laws/show/1238-98-%D0%BF#Text

Clause 5 of this regulation stipulated that foreigners submit to higher education institutions, among other documents, a document on the absence of HIV infection. This regulation has expired September 11, 2013.

The order of the Ministry of Education and Science of Ukraine from 01.11.2013 ? 1541 "Some issues of organization of recruitment and training (internship) of foreigners and stateless persons" is valid now. https://zakon.rada.gov.ua/laws/show/z2004-13#n21

Clause 9 of the Procedure for the organization of recruitment and training (internships) of foreigners and stateless persons, approved by this order, provides an exclusive list of documents that a foreigner personally submits together with the application for admission to an educational institution. There is no document on the absence of HIV on this list. Thus, educational institutions requiring documents on the absence of HIV infection for foreign students contradict the norms of current Ukrainian legislation.
